Public notice inviting bids for the alienation (sale) of building land, cadastral plot no. 365, Landol cadastral municipality, publicly owned by the City of Smederevo

Pursuant to the Decision of the City Council of the City of Smederevo, No. 416-138/2025-09 of 16 June 2025, and in accordance with Articles 15 and 16 of the Decision on the Alienation and Lease of Building Land (“Official Gazette of the City of Smederevo”, No. 5/2015, consolidated text, and 6/2017, Book 4),

the City Council of the City of Smederevo, at its 66th session held on 16 June 2025, issues the following

Public notice inviting bids for the alienation (sale) of building land, cadastral plot no. 365, Landol cadastral municipality, publicly owned by the City of Smederevo

1. The subject of the alienation (sale) is building land, cadastral plot no. 365, entered in property title certificate no. 1508, Landol cadastral municipality, with an area of 13 a 05 m² (1305 m²), publicly owned by the City of Smederevo, with no registered encumbrances. The land is located within the scope of the Spatial Plan of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 3/2011).

2. Data from the planning documents on the building land and the structures that may be built on it are defined in the Spatial Plan of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 3/2011).

1. Cadastral plot data:
   1. Cadastral plot no. 365, with an area of 1305 m², entered in property title certificate no.

1508, Landol cadastral municipality, as public property of the City of Smederevo;

• The plot is located in the Landolski put locality, building land outside the boundaries of the building areas of settlements;
• Planning basis:
  • Spatial Plan of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 3/2011).
• Unit or urban zone in which it is located:
  • Building land outside the boundaries of the building areas of settlements.
• Predominant use of the unit:
  • Housing: weekend house zone;
• Rules for the construction of residential buildings:
• Minimum area of the building plot: 400 m²;
• Width of the building plot frontage: minimum 12.0 m;
• Floor area ratio: maximum 0.6;
• Plot coverage: maximum 30%;
• Building height: maximum G+1+A (ground floor, first floor and attic);
• The minimum distance of the building line of the structure from the regulation line of the plot is determined according to the category/rank of the road to which the structure is connected, but may not be less than 5.0 m;
• The minimum distance between structures is, as a rule, ½ the height of the taller structure, but not less than 4.0 m;
• The minimum distance of the structure from the side boundaries of the plot is 1.5 m where there are no openings of habitable rooms on that side of the structure, and 3.5 m on the opposite side;
• On a building plot in this unit, in addition to the structure of the main use, ancillary and accompanying structures serving the main use may also be built, provided that the conditions defined by the rules for the construction of individual types of structures are met;
• The minimum width of the vehicle access to the yard is 2.5 m for residential buildings;
• Parking for own needs is provided within the plot.

Special notes

• In accordance with the Request for Initiating the Procedure for the Alienation of Building Land, No. 350-90/2025-06 of 19 May 2025, of the Department for Urban Planning, Construction and Investment of the City Administration of the City of Smederevo, the buyer of the cadastral plot in question is required to accept the establishment of a right-of-way easement in favour of cadastral plot 362, Landol cadastral municipality, since the owner of that plot accesses the public road via cadastral plot no. 365, Landol cadastral municipality.

3. The land in question is being alienated (sold) for construction in accordance with the planning document. The building land is sold as undeveloped building land; the plot is accessed from a public road, that is, from a secondary road, and a public road has been built up to the plot.

The buyer takes over the land as seen, without any obligation on the part of the seller to carry out land development works, and without any obligation on the part of the seller to clear or backfill the site.

The buyer undertakes, at his or her own expense, to:

• bring the land into its intended use on the basis of a building permit,
• maintain the land until it is brought into its intended use, in order to prevent the spread of weeds and to protect the environment,
• build connections to the utility infrastructure in accordance with the regulations and the acts of the infrastructure operators, settling the obligations and paying the costs, fees and charges in accordance with the operators’ acts.

4. The land in question is sold by collecting written bids through a Public Notice. The procedure for opening the bids received is conducted by the Commission in accordance with Ruling No. 02-162/2022-09 of 3 August 2022.

5. The starting price for the alienation of the building land of cadastral plot no. 365, with an area of 13 a 05 m² (1305 m²), entered in property title certificate no. 1508, Landol cadastral municipality, for the whole plot is RSD 967,461.75.

Bidders are required to pay a guarantee amount (deposit) of RSD 193,492.35 (20% of the starting price of the land) into the City of Smederevo “Deposits” account no. 840-1089804-04, reference number 97 33841141, payment purpose “deposit for the public notice for cadastral plot no. 365, Landol cadastral municipality”.

A bidder who does not acquire the right to buy the land will have the deposit refunded within ten working days of the date on which the procedure is carried out (the amount refunded is equal to the amount in dinars paid as the deposit).

If the person to whom the building land is being alienated does not proceed to conclude the contract or withdraws the bid, he or she loses the right to a refund of the deposit paid.

The offered price of the building land must be an amount in dinars equal to or higher than the starting amount set by the Decision on Announcing the Public Notice Inviting Bids for the Alienation (Sale) of Building Land, Cadastral Plot No. 365, Landol Cadastral Municipality, Publicly Owned by the City of Smederevo (starting amount: RSD 967,461.75).

The building land is alienated to the person offering the highest price for that land, expressed as an amount in dinars, which may not subsequently be reduced.

The bidder whose bid is accepted (the buyer) is required to pay the established (offered) price of the building land within 15 days of the date of conclusion of the Contract on the Alienation of Building Land.

For the bidder whose bid is accepted, the deposit paid in dinars will be credited towards the purchase price and an amount equal to the deposit will be deducted from the offered price.

The contract on the alienation (sale) of building land is concluded with the City by the person acquiring ownership of the building land, within 30 days of the date of the decision on the alienation (sale) of the building land, all in accordance with the Decision on the Alienation and Lease of Building Land. The contract is concluded on behalf of the City by the Mayor of the City of Smederevo. The seller will put the buyer in possession within 5 days of the date of payment of the purchase price. The buyer also acquires the right to be registered as the owner of the purchased plot after paying the purchase price, on the basis of a confirmation issued by the department of the City Administration of the City of Smederevo responsible for finance.

6. All legal entities, sole traders and natural persons who submit a complete written bid on time are entitled to submit a bid. A bidder may submit only one bid (a bidder holding a majority ownership stake in another legal entity is considered to be the same bidder).

• The bid is submitted to the Commission in a sealed envelope, clearly marked with the cadastral plot to which it relates.
• Bids are submitted to the Commission for the Alienation and Lease of Building Land Publicly Owned by the City of Smederevo for Construction, by post or in person through the filing office of the City Administration of the City of Smederevo, Omladinska 1, 11300 Smederevo.
• Bids will be considered timely if they are received and registered at the filing office of the City Administration of the City of Smederevo by 21 July 2025 at 15⁰⁰.
• The bid must be accompanied by a copy of the document confirming payment of the deposit of RSD 193,492.35.
• The participant in the bidding procedure gives a statement:

a. that he or she accepts the conditions of the Public Notice,

b. that he or she is familiar with:

• the actual condition of cadastral plot no. 365, Landol cadastral municipality,
• the extract from property title certificate no. 1508, Landol cadastral municipality, in the part relating to that cadastral plot,
• the Spatial Plan of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 3/2011),
• the Decision on the Alienation and Lease of Building Land (“Official Gazette of the City of Smederevo”, No. 5/2015, consolidated text, and 6/2017, Book 4),
• The bid of a legal entity or sole trader (in addition to the number of the cadastral plot for which the bid is submitted, a copy of the document confirming payment of the deposit, a valid authorisation for representation and the statement referred to in this item) contains: the name or business name and registered office of the participant in the procedure for collecting bids by public notice, details of registration with the SBRA with an enclosed extract from the register of business entities or other appropriate register, the tax identification number, and the signature of the authorised person and the seal.
• The bid of a natural person (in addition to the number of the cadastral plot for which the bid is submitted, a copy of the document confirming payment of the deposit, a photocopy of the identity card and the statement referred to in this item) contains: name and surname, residential address and unique master citizen number (JMBG).

7. Late and incomplete bids will be rejected.

A late bid is a bid submitted after the expiry of the deadline for submitting bids specified in item 6 of this Public Notice.

An incomplete bid is:

1. a bid submitted in an open envelope or without a visible indication of the cadastral plot to which it relates;

2. a submitted bid that does not contain the details and complete documents referred to in item 6 of this Public Notice, and

3. a submitted bid in which the offered price of the building land is not in accordance with paragraph 5 of item

5 of this Public Notice.

8. Bidders are informed that they are not required to pay a fee for the change of use from agricultural land to building land.

9. The public opening of bids will be conducted by the Commission for the Alienation and Lease of Building Land Publicly Owned by the City of Smederevo for Construction referred to in item 4 of this Public Notice.

The public opening of bids will take place on 23 July 2025, starting at 12⁰⁰, in the building of the City Administration of the City of Smederevo, Omladinska 1, Assembly Hall.

10. The procedure for collecting bids through the Public Notice is considered successful if at least one timely and complete bid has been received.

The bid opening procedure is public and all interested parties may attend.

11. The procedure for collecting bids and the procedure for concluding the Contract on the Alienation of Building Land will be conducted in accordance with the Decision on the Alienation and Lease of Building Land (“Official Gazette of the City of Smederevo”, No. 5/2015, consolidated text, and 6/2017, Book 4).

12. The City of Smederevo reserves the right to withdraw from the alienation of the real estate from the public property of the City of Smederevo at any time until the contract is signed.

If, by the date of signing (solemnisation) of the contract on the alienation of the building land of cadastral plot no. 365, Landol cadastral municipality, with an area of 13 a 05 m² (1305 m²), the estimated market value of this cadastral plot increases on the basis of an assessment by the Commission for Assessing the Market Value of Real Estate of the Tax Administration, Sector for Separate Activities, Small Locations Control Group Smederevo, the City Council of the City of Smederevo has the right to annul this Public Notice and the Decision on Announcing the Public Notice Inviting Bids for the Alienation (Sale) of Building Land, Cadastral Plot No. 365, Landol Cadastral Municipality, Publicly Owned by the City of Smederevo, if the new estimated market value of this cadastral plot is higher than the highest price offered.
