Pursuant to Articles 16 and 17 of the Decision on the Use of Public Areas in the Territory of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 1/2020 (consolidated text) and 7/2022), and in accordance with Article 11, Tariff No. 1 of the Decision on Fees for the Use of Public Areas for the Territory of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 1/2020 (consolidated text) and 7/2024), the Programme of Locations for Placing Temporary Prefabricated and Mobile Business Structures and Other Structures (“Official Gazette of the City of Smederevo”, No. 6/2021, 2/2022, 7/2022 and 5/2024), the Programme Supplementing the Programme of Locations for Placing Temporary Prefabricated and Mobile Business Structures and Other Structures, No. 352-1216/2024-09 of 20 January 2025, and the Decision on Issuing the Public Call for Applications for Collecting Written Bids for the Temporary Use of a Public Area for Business and Other Activities, No. 352-68/2025-09 of 10 February 2025,

  1. The subject of collecting written bids is the granting of space in a public area for temporary

use for business and other activities for a fixed term, at most until the expiry of the Programme of Locations for Placing Temporary Prefabricated and Mobile Business Structures and Other Structures (“Official Gazette of the City of Smederevo”, No. 6/2021, 2/2022, 7/2022 and 5/2024), i.e. until 19 July 2026, at the following locations:

  • The said space in a public area is granted for use by collecting written

bids.

  • The most favourable bidder for all locations listed in the Public Call is selected by applying

the criterion of the amount of the fee offered.

  • The following are eligible to take part in the Public Call: sole traders, legal entities, natural persons and

registered agricultural producers who submit a proper and timely written

bid to the City Administration of the City of Smederevo.

The following are not eligible to take part in the Public Call:

  • persons who have not settled their obligations under previous or current contracts under which they acquired the right to use a public area;
  • persons who, as established by the Commission, submitted the most favourable bid in previous procedures but later withdrew it, and persons who did not conclude a contract on the use of a public area;
  • persons and their authorised representatives who were removed by the Commission from the room in which the Commission was sitting for disrupting its work in any of the previous procedures.
  • The bid for the temporary use of a public area for business and other

activities (hereinafter: the bid) must contain:

  • for registered agricultural producers: first name and surname, address, identity card number, unique master citizen number and confirmation of the active status of the holding;
  • for sole traders: the sole trader’s first name and surname, address, identity card number, unique master citizen number, business name, tax identification number (PIB), registration number and proof of the registered activity, or a signed statement in accordance with Article 103, paragraph 3 of the Law on General Administrative Procedure;
  • for legal entities: name, registered office, tax identification number (PIB), registration number and proof of the registered activity, or a signed statement in accordance with Article 103, paragraph 3 of the Law on General Administrative Procedure;
  • for natural persons: first name and surname, address, identity card number and unique master citizen number.
  • The bid must also contain the amount offered for the specific location expressed exclusively as a fixed amount in dinars, the number or designation of the site in the Programme for which the bid is submitted (write: Serial number designation in the Programme), proof of payment of the deposit, the number of the account to which the deposit is to be refunded, and confirmation from the Department for Local Tax Administration and the Department for Finance of the City Administration of the City of Smederevo that the participant in the call has no outstanding obligations for the use of a public area for business and other activities.
  • The written bid is submitted in a sealed envelope marked “Bid for the temporary use of a public area, serial number designation in the Programme ________, do not open”, to the following address: City Administration of the City of Smederevo (for the Commission for Granting Space in a Public Area for Temporary Use for Business and Other Activities), Omladinska 1, Smederevo.
  • The following will be considered timely bids:
  • written bids received and logged at the filing office of the City Administration of the City of Smederevo by 3 March 2025 at 1500;
  • written bids sent exclusively by registered post by 3 March 2025 at 1500, provided that the item reaches the City Administration before the bids are opened
  • An incomplete bid is a bid submitted that does not contain the details required by the Public Call.
  • The Commission will reject incomplete and late bids by a ruling.
  • A deposit of 20% of the starting bid amount for the specific location, for each site separately, is paid into the account of the City Administration of the City of Smederevo no. 840-1089804-04, reference number 97 06714565, payment purpose “fee for the use of space in a public area”. For the bidder whose bid is accepted as the most favourable, the deposit paid will be counted towards the fee for the use of the space in the public area, and the deposit will be refunded to the other participants within 10 days of the adoption of the Decision of the City Council of the City of Smederevo on granting space in a public area for temporary use for business and other activities, to the account number given in the bid for the refund of the deposit.
  • The public opening of bids will be conducted by the Commission for Granting Space in a Public Area for Temporary Use for Business and Other Activities, established by a Ruling of the City Council of the City of Smederevo.
  • The public opening of bids will take place on 5 March 2025, in the Great Hall of the Assembly

of the City of Smederevo, Omladinska 1, starting at 1200.

  1. The conditions for conducting the procedure for the temporary use of space in a public area for business and other activities are also met if only one bidder submits a bid, provided that it is timely and complete. If two or more bidders in the procedure offer the same amount, the Commission will invite the bidders who offered the same amount to submit, within 3 days of receiving the invitation, a new sealed written bid with a higher amount than their previous bid, and the Commission will open these bids and determine the most favourable bidder. If these bidders do not submit a new bid, or if they submit new bids with identical amounts, the Commission will select the most favourable bidder by drawing lots. If the bidder selected by the Commission as the most favourable withdraws from the use of the public area or does not conclude the contract on its use, the procedure will be repeated, and the bidder will lose the right to a refund of the deposit.
  2. After the procedure for opening the written bids, the Commission will, within 8 days, draw up a proposal for adopting a decision on granting space in a public area for temporary use to the most favourable bidder. The decision on granting space in a public area for temporary use for business and other activities is adopted by the City Council.
  3. The City and the user conclude a contract on the temporary use of the public area. The contract on the temporary use of the public area is concluded within 30 days of the decision on granting space in the public area being delivered to the user.
  4. Before starting to use the public area, the user of the space must obtain approval from the competent department for the use of the public area for business or other activities. The user of the space must submit the application for this approval to the competent department within 7 days of the conclusion of the contract.
  5. The user of the public area must arrange with the utility companies, and pay, the costs of connection to the infrastructure networks (water, sewerage, electricity, gas), if such connections are needed.

The user of the public area must use the public area in accordance with the approval. Before concluding the contract with the City, the user of the public area must complete the appropriate registration for carrying out the relevant activity and submit the documents proving this to the competent department.

The user of the public area must conclude a contract with the competent public utility company for refuse collection, and keep the temporary business structure and the space around it in good order.

  1. The user of the public area must ensure that the operation of the structure does not endanger the safety of citizens using the public area in the immediate vicinity of the structure.
  2. The fee for the use of part of the public area is paid as follows: the difference between the amount offered by the most favourable bidder in the call procedure and the starting fee set by the call is paid in a single instalment within 30 days of the conclusion of the contract, while the remainder is paid in accordance with the separate decision on fees for the use of public areas. Article 6 of the Decision on Fees for the Use of Public Areas in the Territory of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 1/2020, consolidated text) stipulates that the fee for the use of a public area is determined according to the area of the space used, in proportion to the duration of use of that space, or according to the technical and functional characteristics of the structures. The fee referred to in paragraph 1 of this Article is set by a ruling of the Department for Local Tax Administration on the basis of the approval previously issued by the competent department of the City Administration of the City of Smederevo in accordance with the regulations, which must deliver one copy of the approval to the Department for Local Tax Administration.
  3. The temporary prefabricated, mobile or other business structure is placed by the user of the public area directly, and the user bears all the costs of placing or building the business structure and of obtaining the necessary permits and consents, as well as the costs of connecting the structure to the infrastructure networks (water, sewerage, electricity, gas).
  4. NOTE: For the locations under the following serial numbers in the Programme of Locations for Placing Temporary Prefabricated and Mobile Business and Other Structures, only a single bid may be submitted:
  • 55/1 and 55/2;
  • 59/1 and 59/2;
  • 107/1 and 107/2;
  • 113/1, 113/2 and 113/3;

Article 5, paragraph 3 of the Decision on the Use of Public Areas in the Territory of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 1/2020 (consolidated text) and 7/2022) stipulates that a small prefabricated structure is a structure built to a special design from prefabricated elements, with a gross area of 10 m2 to 30 m2; because of this area limit, it was necessary to divide the location into two or more parts in the Programme.
