Public call for applications for written bids for the temporary use of a public area for business and other activities

Pursuant to Articles 16 and 17 of the Decision on the Use of Public Areas in the Territory of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 1/2020, consolidated text, and 7/2022), and in accordance with Article 11, Tariff No. 1 of the Decision on Fees for the Use of Public Areas for the Territory of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 1/2020, consolidated text, and 7/2024), the Programme of Locations for the Placement of Smaller Temporary Demountable Structures and Temporary Mobile Structures (“Official Gazette of the City of Smederevo”, No. 3/2023 and 8/2024), the Programme Supplementing the Programme of Locations for the Placement of Smaller Temporary Demountable Structures and Temporary Mobile Structures, No. 352-790/2026-09 of 25 May 2026, and the Decision on Announcing the Public Call for the Collection of Written Bids for the Temporary Use of Public Areas for Business and Other Activities, No. 352-790/2026-09 of 8 June 2026,

Commission for the Procedure of Granting Space in Public Areas for Temporary Use for Business and Other Activities

issues the following

Public call

for the collection of written bids

for the temporary use of public areas for business and other activities

1. The subject of the collection of written bids is the granting of space in public areas for temporary

use for business and other activities for a fixed period, at most until the expiry of the Programme of Locations for the Placement of Temporary Prefabricated and Mobile Business Structures and Other Structures (“Official Gazette of the City of Smederevo”, No. 6/2021, 2/2022, 7/2022, 5/2024 and 1/2025), that is, until 19 July 2026, at the following locations:

• The above space in public areas is granted for use through the collection of written

bids.

• The most favourable bidder for all the locations listed in the Public Call is selected by applying

the criterion of the amount of the fee offered.

• The following are eligible to take part in the Public Call: sole traders, legal entities, natural persons and registered agricultural producers who submit a complete and timely written bid to the City Administration of the City of Smederevo.

The following are not eligible to take part in the Public Call:

• persons who have not settled their obligations under previous or current contracts under which they acquired the right to use a public area;
• persons whom the Commission has found to have submitted the most favourable bid in previous procedures but to have later withdrawn it, and persons who did not conclude a contract on the use of a public area;
• persons and their authorised representatives who were removed by the Commission from the room in which it was sitting for disrupting its work in any of the previous procedures.

• A bid for the temporary use of a public area for business and other activities (hereinafter: the bid) must contain:
• for registered agricultural producers: first name and surname, address, identity card number and unique master citizen number, and confirmation of the active status of the farm;
• for sole traders: the sole trader’s first name and surname, address, identity card number, unique master citizen number, business name, tax identification number (PIB), registration number and proof of the registered activity, or a signed statement in accordance with Article 103, paragraph 3 of the Law on General Administrative Procedure;
• for legal entities: name, registered office, tax identification number (PIB), registration number and proof of the registered activity, or a signed statement in accordance with Article 103, paragraph 3 of the Law on General Administrative Procedure;
• for natural persons: first name and surname, address, identity card number and unique master citizen number.
• The bid must also contain the amount offered for the specific location expressed exclusively as a fixed amount in dinars, the number or designation of the site from the Programme for which the bid is submitted (write: the serial number designation from the Programme), proof of payment of the deposit, the number of the account to which the deposit is to be refunded, and confirmation from the Department for Local Tax Administration and the Department for Finance of the City Administration of the City of Smederevo that the participant in the call has no outstanding obligations arising from the use of a public area for business and other activities.
• The written bid is to be submitted in a sealed envelope marked “Bid for the temporary use of a public area, serial number designation from the Programme ________, do not open” to the address: City Administration of the City of Smederevo (for the Commission for Granting Space in Public Areas for Temporary Use for Business and Other Activities), Omladinska 1, Smederevo.
• The following will be considered timely bids:

• written bids received and registered at the filing office of the City Administration of the City of Smederevo by 2 July 2026 at 15⁰⁰;
• written bids sent by post, exclusively by registered mail, by 2 July 2026 at 15⁰⁰, provided that the item reaches the City Administration before the bids are opened

• A late bid is a bid submitted after the deadline for submitting bids, that is, after the deadline referred to in point 8 of this Public Call.
• An incomplete bid is a submitted bid that does not contain the information required by the Public Call.
• The Commission will reject incomplete and late bids by a ruling.
• A deposit of 20% of the starting bid amount for the specific location is to be paid for each site separately into the account of the City Administration of the City of Smederevo no. 840-1089804-04, reference number 97 06714565, payment purpose “fee for the use of space in a public area”. For the bidder whose bid is accepted as the most favourable, the deposit paid will be counted towards the fee for the use of space in a public area, while the deposit will be refunded to the other participants within 10 days of the adoption of the Decision of the City Council of the City of Smederevo on granting space in public areas for temporary use for business and other activities, to the account number given in the bid for the refund of the deposit.
• The public opening of bids will be conducted by the Commission for Granting Space in Public Areas for Temporary Use for Business and Other Activities, established by a Ruling of the City Council of the City of Smederevo.
• The public opening of bids will take place on 6 July 2026 in the Main Hall of the City Assembly of Smederevo, Omladinska 1, starting at 12⁰⁰.

1. The conditions for conducting the procedure for the temporary use of space in public areas for business and other activities are also met if only one bidder submits a bid, provided that it is timely and complete. If two or more bidders in the procedure offer the same amount, the Commission will invite the bidders who offered the same amount to submit, within 3 days of receiving the invitation, a new sealed written bid with a higher amount than in their previous bid; the Commission will open these bids and determine the most favourable bidder. If those bidders do not submit a new bid within 3 days, or if they submit new bids for identical amounts, the Commission will select the most favourable bidder by drawing lots. If the bidder selected by the Commission as the most favourable withdraws from using the public area or does not conclude the contract on its use, the procedure will be repeated and the bidder loses the right to a refund of the deposit.
2. After the procedure for opening the written bids has been completed, the Commission will, within 8 days, draw up a proposal for a decision on granting space in a public area for temporary use to the most favourable bidder. The decision on granting space in a public area for temporary use for business and other activities is adopted by the City Council.
3. The City and the user conclude a contract on the temporary use of the public area. The contract on the temporary use of the public area is concluded within 30 days of the delivery to the user of the decision on granting space in a public area.
4. Before starting to use the public area, the user of the space must obtain approval from the competent department for the use of the public area for business or other activities. The user of the space must submit the application for this approval to the competent department within 7 days of concluding the contract.
5. The user of the public area must arrange with the competent companies, and pay, the costs of connection to the infrastructure networks (water, sewerage, electricity, gas), if such connections are needed.

The user of the public area must use the public area in accordance with the approval. Before concluding the contract with the City, the user of the public area must complete the appropriate registration for carrying out the relevant activity and submit the documentation to the competent department.

The user of the public area must conclude a contract with the competent public utility company for waste collection and keep the temporary business structure and the space around it clean and tidy.

• The user of the public area must ensure that the operation of the structure does not endanger the safety of citizens using the public area in the immediate vicinity of the structure.
• The fee for the use of part of a public area is paid as follows: the difference between the amount offered by the most favourable bidder in the procedure and the starting fee set by the call is paid in a single instalment within 30 days of concluding the contract, while the remainder is paid in accordance with the separate decision on fees for the use of public areas. Article 6 of the Decision on Fees for the Use of Public Areas in the Territory of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 1/2020, consolidated text, and 7/2024
• ) provides that the fee for the use of a public area is determined according to the area of the space used, in proportion to the period of use of that space, or according to the technical and functional characteristics of the structures. The fee referred to in paragraph 1 of this Article is set by a ruling of the Department for Local Tax Administration on the basis of the approval previously issued, in accordance with regulations, by the competent department of the City Administration of the City of Smederevo, which must deliver one copy of the approval to the Department for Local Tax Administration.
• Smaller temporary demountable structures and temporary mobile structures are installed by the user of the public area directly, and the user bears all the costs of installing or constructing the business structure and of obtaining the necessary permits and consents, as well as the costs of connecting the structure to the infrastructure networks (water, sewerage, electricity, gas).
