Notice on the lease of real estate (a hall) in public ownership of the City of Smederevo through the collection of written bids

The City of Smederevo, Commission for Business Premises of Special Importance for the City, pursuant to the Conclusion of the City Council of the City of Smederevo No. 368-185/2024-09 of 18 September 2024, publishes the following

Notice
on the lease of real estate (a hall) in public ownership of the City of Smederevo through the collection of written bids

SUBJECT OF THE NOTICE: A hall in public ownership of the City of Smederevo, with a total net floor area of 4,158.30 m² consisting of a production section of 2,557.00 m², a management and administrative section of 345.00 m² and two annexes of 1,154.64 m² and 101.66 m². The hall is located on cadastral plot No. 233/70, Smederevo cadastral municipality, and is leased in the condition in which it stands.

Activities that may be carried out in the hall:

light industry (mainly processing): higher forms of processing, high-tech production of

electronic and metal products,

ancillary activities (trade, business, administration and the like), either independently or as part of

individual production complexes,

activities covered by the List of Projects Requiring an Environmental Impact Assessment

(List 1) of the Decree Establishing the List of Projects Requiring an Impact Assessment

and the List of Projects for Which an Environmental Impact Assessment May Be Required

(“Official Gazette of the Republic of Serbia”, No. 114/2008) are excluded.

LEASE TERM: 1 (one) year from the date the contract is signed. The selected bidder must conclude a lease contract for the real estate (the hall) that is the subject of this Notice with the City of Smederevo within 15 days of receiving the invitation from the lessor, the City of Smederevo, to conclude the contract.

STARTING (LOWEST) MONTHLY RENT: EUR 12,474.90 (in words: twelve thousand four hundred and seventy-four euros and 90/100) in the dinar equivalent at the official middle exchange rate of the National Bank of Serbia on the day of payment.

Value added tax will be charged on the monthly rent achieved in the written bid procedure, unless otherwise provided by law or a by-law.

The monthly rent for the hall does not include the costs of routine maintenance of the hall, insurance, heating, electricity, gas, water, waste collection, postal and telecommunications services, local utility fees and the like, which are borne by the lessee. Rent is charged from the moment the lessee is put in possession of the hall.

ELIGIBILITY: All legal entities registered with the Serbian Business Registers Agency for carrying out the activities set out in this Notice are eligible to take part under this Notice, except:

• persons who in a previous procedure offered or bid the highest rent and then withdrew from concluding the lease contract or terminated the contract before the agreed term expired, for one year from the date of withdrawing from concluding the contract or of terminating the contract, and
• persons (lessees and users) who have not settled their debts arising from the lease or use of business premises or real estate in public ownership of the City of Smederevo, and their legal successors.

At the time of signing the contract, the legal entity must have its registered office in Smederevo.

DEPOSIT PAYMENT: The bidder must pay a deposit of EUR 12,474.90 (in words: twelve thousand four hundred and seventy-four euros and 90/100) in the dinar equivalent at the official middle exchange rate of the National Bank of Serbia on the day of payment. The deposit is paid into the account of the Smederevo City Administration (deposits), account No. 840-1089804-04, quoting reference number 07742145 under model 97, and proof of payment is submitted with the written bid.

As security for the performance of the contractual obligations, the lessee undertakes to provide the lessor, at the latest when the contract is concluded, with a bank guarantee in the amount of two months’ rent, which must be unconditional and payable on first demand, with a validity period 60 (sixty) days longer than that of the Lease Contract.

Participants who are unsuccessful in the written bid procedure will have their deposit refunded within 10 days of the decision to lease the hall to the most favourable bidder. For the bidder whose bid is accepted, the deposit is counted towards the rent. The bidder whose bid is accepted loses the right to a refund of the deposit if it withdraws from the lease of the hall or fails to conclude the lease contract within 15 (fifteen) days of receiving the lessor’s invitation.

The written bid must contain:

the name and registered office of the legal entity, a copy of the ruling on the entry of the legal entity in the register of the competent authority, a power of attorney for the person representing the applicant, the monthly rent offered in euros as a fixed amount equal to or higher than the starting amount set by this Notice, the activity to be carried out in the hall in accordance with the purpose set out in this Notice, proof of payment of the deposit, the number of the account to which the deposit will be refunded if the bid is not accepted as the most favourable, and proof that the bidder has paid the rent if it is already a lessee of real estate or business premises in public ownership of the City of Smederevo.

General conditions of the notice:

• Written bids are to be submitted in a sealed envelope marked “Bid for the lease of real estate (hall), Do not open”, to the address: City Administration of the City of Smederevo, Commission for Business Premises of Special Importance for the City, Omladinska 1, 11300 Smederevo.
• written bids received and registered at the filing office of the City Administration of the City of Smederevo by 25 December 2024 at 15⁰⁰;
• written bids sent exclusively by registered post by 25 December 2024 at 15⁰⁰, provided that the item has arrived and been registered at the City Administration by the time set by this Notice for opening the bids received.
• The written bids will be opened on 27 December 2024 in the Assembly Hall of the City of Smederevo, starting at 12⁰⁰.
• A late bid is a bid submitted to the filing office of the City Administration of the City of Smederevo after the deadline for submitting bids set in indent 2 of this item.
• An incomplete bid is a bid that does not contain everything prescribed by this Notice, that is, does not contain all the information required by this Notice, or in which the information is given contrary to this Notice.
• Incomplete and late bids will not be considered and will be rejected.
• The criterion for selecting the most favourable bidder is the amount of the monthly rent offered, expressed in euros.
• Bidders may inspect the documents relating to the hall every working day while this Notice is open, from 8⁰⁰ to 15⁰⁰, on the premises of the City Administration of the City of Smederevo, office no. 55.
• The hall may be viewed every working day while the Notice is open, from 8⁰⁰ to 15⁰⁰.
• The procedure for leasing the real estate (the hall) that is the subject of this Notice is conducted by the Commission for Business Premises of Special Importance for the City, established by a Ruling of the City Council of the City of Smederevo. The provisions of the Decision on the Acquisition and Disposal of Assets in Public Ownership of the City of Smederevo (“Official Gazette of the City of Smederevo”, No. 1/2020, consolidated text, 2/2021 and 7/2024), which governs the lease of real estate in public ownership, will apply to the procedure for implementing this Notice.
